1. Acceptance of Terms
By accessing or using RecallPing ("the Service"), operated by RecallPing ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
RecallPing is an informational service that monitors federal recall feeds from agencies including the FDA, USDA, CPSC, and NHTSA, and sends personalized push and email alerts based on your household profile. The Service is intended to supplement, not replace, official government recall channels.
RecallPing does not guarantee that it will catch every recall, deliver every notification without delay, or that the information provided will be complete, accurate, or timely. You should always verify recall information through official sources such as recalls.gov.
3. Not Professional Advice
The Service does not constitute medical, safety, legal, or any other form of professional advice. RecallPing alerts are informational only. You should not rely solely on RecallPing for protection from illness, injury, or death. Always consult qualified professionals for decisions related to health, safety, or legal matters.
4. Eligibility
You must be at least 18 years of age to use RecallPing. By using the Service, you represent and warrant that you meet this age requirement.
5. Account and Profile Information
You are responsible for providing accurate and up-to-date information in your household profile, including allergies, medications, vehicles, brands, and other items. The accuracy of your recall alerts depends directly on the accuracy of your profile. RecallPing is not liable for missed alerts caused by incomplete or inaccurate profile data.
6. Subscription and Billing
RecallPing is offered as a subscription service at $34.99 per year. New subscribers receive a 30-day free trial. You may cancel your subscription at any time. Upon cancellation, you will continue to have access through the end of your current billing period. Payments are processed through Stripe. All fees are in US dollars.
7. Data Collection and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Service Availability
We strive to maintain continuous availability of the Service, but we do not guarantee uninterrupted access. The Service may experience downtime for maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from service interruptions.
9. Limitation of Liability
To the fullest extent permitted by applicable law, RecallPing and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages for personal injury, property damage, lost profits, or loss of data.
In no event shall RecallPing's total liability to you exceed the amount you have paid for the Service in the twelve (12) months preceding the event giving rise to the claim.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Indemnification
You agree to indemnify and hold harmless RecallPing and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction within the United States.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by canceling your subscription and contacting us.
